Partner Don Thompson prevails on a constitutional speedy trial argument before the Second Circuit

In a formerly-capital Hobbs Act robbery/murder case, the Second Circuit affirmed the District Court’s decision dismissing all remaining counts of the indictment on constitutional speedy trial grounds after the conclusion of a nearly 3 month trial in the Western District of New York. Both lower and appellate courts faulted the government for taking 2 years 10 months to decide to not seek capital punishment, taking 2 years 9 months to supercede the original indictment...
