On Monday August 30, 2021, State Supreme Court Justice Thomas Moran agreed with ETKS Partner Larry Kasperek’s motion to dismiss the wrongful conviction of client Ronnie Edmonds. The Monroe County District Attorney’s Office agreed to the dismissal, acknowledging that “impeachment” information — records that would allow defense lawyers to challenge the integrity and reliability of arresting officers — was not given to Edmonds’ previous attorney. At the hearing before Judge Moran, Larry said that prosecutors in the DA’s Office had ignored “their statutory obligations, their constitutional obligations, and their ethical obligations” by not earlier highlighting the credibility questions with the officers. Larry’s motion along with a motion from fellow ETKS Partner Brian Shiffrin have started a complete review amongst defense attorneys within Rochester as well as the Monroe County District Attorney’s Office involving client’s convicted based on the testimony of the two officers cited in Larry’s case for their false testimony. Larry believes a “tidal wave” of motions for relief on behalf of individuals who have been wrongfully convicted based on these officer’s false testimony will ensue.
